Given how easy it is to learn anything about anyone these days, and further given that the govt has computers, too, we should: “Take things like FOIA [Freedom of Information Act] and put it on steroids — the presumption should be that documents are not revealed on request, but that they are made publicly electronically available and searchable by default.”

    Sunset limits on all laws would be a similar proposal. One suspects that that Sunstein and Thaler fail to include suggestions like this in their proposed Friendly Paternalism: the problem is always with the governed, never with their overlords governors.
